Summary/Abstract: The proliferation of private military and security campaigns (PMSC) has eroded lately the state traditional monopole with regards to the use of force. In the context of foreign military presence on the territories of weaker states or those bearing internal conflicts (Iraq, Afghanistan, Columbia), PMSC carries out extended security functions. Frequently, they breach human rights and affect the quality of the population’s life, considering the fact that the legislative background in the countries these campaigns originate in (USA, Western Europe) and the international norms are insufficiently developed and often scanty. Under these conditions, the member states of ONU and particularly the European states should continue their efforts to improve the international juridical framework regarding the PMSC, with the large contribution of experts and civil society organizations.
