Summary/Abstract: Greitas narkotinių medžiagų plitimas ir kovos su šiuo reiškiniu priemonių neveiksmingumas kelia būtinybę iš pagrindų peržiūrėti mūsų šalyje veikiančią narkotinių medžiagų pristatymo ir platinimo kontrolės sistemą. Pirmiausia turėtų būti tobulinamas atsakomybę už narkotikų kontrabandą reglamentuojančios baudžiamosios teisės normos (BK 199 straipsnio 2 dalis) turinys. Straipsnio autorių tikslas ? patikslinti šios normos vietą BK sistemoje, aptarti ja saugomą viešąjį gėrį ir jos turinio esminės pertvarkos būdus. Dabartinis minėtos veikos teisinis vertinimas iškreipia kovos su narkotikų paplitimu tikslus, o teisinis reglamentavimas aiškiai neatitinka narkotikų visuomenei daromos žalos apimčių ir mažina kovos su narkotinių medžiagų platinimu veiksmingumą. The increase in illegal drugs delivery and consumption in Lithuania and the inefficiency of legal and other counter-measures aimed to combat these trends bring the necessity of a radical review of the whole drug control system. The first step in this direction should be the specification of the Lithuanian criminal law provisions persecuting drug delivery and consumption. This specification should be started with the revision of the place of counter-drug provisions among other provisions of the Special Part of the Criminal Code. The most important is to review the common good that is supposed to be protected by this provision. All counter-drug provisions have to be consolidated in a single section of criminal law which is supposed to protect the most basic social goods – one‘s life and health. This will bring the legal assessment of this provision in conformity with the real importance of the social good that is protected by it. This, next, provides further opportunities for the best formulation of anti-drug provisions and one‘s responsibility for their violation.
