Summary/Abstract: The preliminary statement is a new institute of the new Civil Code and serves to protect people in the event that she or he is not able to make their decisions, for example, due to mental illness. In anticipation of their inability to carry out their own legal affairs, they can write a preliminary statement how their affairs are to be managed or delegate someone to manage these affairs on their behalf or even delegate someone to become their legal guardian. Previously, a person could not determine who would become their guardian. The civil law had served only two institutes to protect mental health – the restriction or the deprivation of person´s legal capacity.
