Summary/Abstract: The article deals with the legal question wheather so called consultative local referendum may be held in accordance with a czech legislation in force. Consultative local referendum is therein uderstood as a referendum in which citizens of a municipality takes an opinion on a matter, about which the municipality itself (within its own self-government) is not authorized to take a legally binding decision, but on which is only entitled to be heard as a party by a competent authority. The author argues against a resolution of the Constitutional Court sg. II. ÚS 706/04, analyses applicaple rules of law and concludes that czech legislation allowes consultative local referenda to be held.
