Summary/Abstract: Treaty of Lisbon ratification was a difficult exercise lasting for nearly two years. The paper deals with comparison of deliberation, legal character and scope of application of so called Irish guarantees and Czech guarantees, as agreed at the level of the European Council to pave the way to final ratification of the Treaty. Comparing a structure, legal status and scope of application the author comes to a conclusion that despite different motivation, both sets of instruments do not represent any derogation neither to the Treaty nor to the Charter of Fundamentals Rights of the EU but clarification which would prevent the extensive interpretation of the Treaty provisions and of the Charter by the Court of Justice of the European Union.
