The rights of the victim within the Criminal proceedings

Summary/Abstract: The present paper outlines the legal framework pertaining to the participation of the victim of an offence within the criminal proceedings, the emphasis being placed on the victim’s rights. Both the EU legal instruments in the field and the Romanian provisions set out under the Criminal Procedure Code – as recently amended and supplemented by the Government Emergency Ordinance no. 18/2016 and Law no. 151/2016 regarding the European protection order and the amending and supplementing of certain egal acts – as well as under specific pieces of legislation are analyzed. Moreover, the relevant case law ensures the dynamism of the victim’s rights in the law enforcement process.
