Summary/Abstract: Тhe current article aims at analyzing the statement made by the accused person or witness in the criminal trial. Some cases, different hypoteses and certain problems in practice are presented. In this context, in conclusion the principle positions according to the Article 6, para 1 and 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms are analyzed, too.
