Summary/Abstract: From the declarative attitude, stated through “The Universal Declaration of The Human Rights” adopted by The United Nations Organization at the 10th of December of 1948, it was passed, on an European aspect, at the juridical consecration and at the creation of the instruments and of the jurisdictional institutions of defense and effective guarantying of the definitive rights and liberties for the human being, through the adoption at Rome, on the 4th of November of 1950, of The Convention for the defense of the human rights and of the fundamental liberties (known and entered in the frequent language under the Denomination of The European Convention of The Human Rights), ratified by Romania at the 31st of May 1994, and of The European Court of The Human Rights, normatively stated through The Second Title the art. 19 letter b from The Convention.
