The energy performance of buildings - legal aspects (selected issues).

Summary/Abstract: This article aims to provide guidelines for the currently applicable EU law regulations on energy performance of buildings that are a constitutive instrument for implementing the climate and energy package pursuant to the Kyoto Protocol. The authors also present the state of the Polish legislation and its adjustment to the requirements set by the EU legislator. The authors analyze and assess the assumptions of the Polish draft legislation on energy performance of buildings, paying particular attention to the implementation of the postulate that within the specific term all new buildings in the European Union should have nearly zero-energy consumption, as well as to the problem of sanctions for non-fulfillment of the legal obligations emerging from the implementation of the EU legislation.
