Summary/Abstract: Regarding the evidence, the principle of freedom applies, meaning that any evidence should be admitted unless it is forbidden by law, while regarding the means of evidence the principle of legality does not operate. This principle, consecrated by article 64, Criminal Procedure Code, has a double aspect: on one side, the evidence should be gathered by certain means of evidence, regulated by law (article 64 paragraph 1), on the other side, the means of evidence should be legally obtained (article 64 paragraph 2).
