Summary/Abstract: The article focuses on the issues related to the development of a new concept for the rule of law with the aim to respond to the challenges of the modern society. With reference to its requirements it discusses two recent cases decided by the Court of the European Union related to the data protection in internet: the Google Spain case and the annulment of the Data Retention Directive
