Summary/Abstract: Generally, the law systems that incriminate the attempt refer to two elements: the act of performance, specific to the material element and the intent to commit, specific to the subjective element. For example, the German Criminal Code, in paragraph 22, sets out that an attempt to a crime is committed when a person begins to commit a crime directly, according to his/her decision that he/she will commit that crime and according with paragraph 23 III, when the perpetrator did not know, out of simple ignorance, that the perpetration of the crime would not be possible either due to the particularities of the aimed object, or due to the used means, the court may decide to waive punishment or decrease it, according to its opinion.
