Summary/Abstract: At the first view, on the basis of the provisions of art.53, para. (1) of the Criminal Procedure Code, it seems that the solving of this request is of the competence of the prosecutor hierarchically superior. However, in our opinion, the solving of this request is of the competence of the judge appointed to solve the proposal for a preventive arrest, as said request was addressed to this judge.
