Summary/Abstract: A few contradictory solutions taken in the judiciary practice, combined with the putting into the public debate of the drafts of the Penal Procedure Code and the Civil Procedure Code, wherein modifications are proposed towards the existing regulations, offer us the opportunity to approach a few aspects of the civil and penal proceedings in the existing regulation vs. the last drafts proposed.
