Summary/Abstract: In the case Allan vs. Great Britain, the Court showed that the right against selfincrimination serves, in principle, to guarantee the right to silence to a suspect. This liberty would be compromised in case the authorities would use subterfuges in order to obtain from the suspects self-incriminating declarations they could not obtain in a normal hearing during the penal prosecution and that will be used later, as evidences in the trial.
