CONCERNING THE MOMENT OF ESTABLISHING A LABOUR RELATIONSHIP

Summary/Abstract: Three types of grounds for establishing of a labour relationship are provided by the Labor Code – contract of employment, election and competition. But if after the realisation of these facte the worker (employee) does not beginn the fulfillment of his labour obligatons according to the law the relationship is considered as not established. This means (positively said), that the beginning of the fulfillment of the labour duties is a constitutive part of the grounds of labour relationship. So the start of fulfilment of the worker’s (employee’s) obligations duties) is actually concluding in the each of other „grounds” for establishment of a labour relationship. Namely this defines the the moment of beginning of fillfilment of duties as a moment in which the labour relationship must be considered as established.
