Opinion on the scope of notification requirement of a Deputies’ bill on the selling of food by farmers and amending certain other acts, along with the self amendment

Summary/Abstract: The opinion concerns the scope of the requirement to notify draft legislation. In an earlier opinion Bureau of Research of the Chancellery of the Sejm (BAS) said that the bill contained technical regulations within the meaning of Directive (EU) 2015/1535 and is subject to notification to the European Commission.The author indicates the provisions of the draft which must be classified as technicalregulations. He claims that, due to the requirement to send to the Commission – inaddition to the draft technical regulations – the text of the basic legislative or regulatoryprovisions principally and directly concerned, it is considered that the entire billis subject to notification. The notification requirement also covers reasons why themeasure is being introduced.
