Summary/Abstract: In this paper the legal nature of a housing cooperative is studied to reveal the gist and the role of this form of a legal institution. The author criticizes the concept of perception of house management organizations as legal entities of public law. Despite the dominating idea of administrative nature of housing cooperatives, the article substantiates their contractual nature.
