Summary/Abstract: This article studies the factors that worsen the quality of penal legislation, e.g. conflicting and competing rules, gaps, contradictions, and judicial discretion at the stage of execution of criminal sentences. The author concludes that the penal legislation of the Russian Federation needs modernization as minimum and radical reforms as maximum.
