Summary/Abstract: Basic regulations governing illegal trade in human cells, tissues or organs have been binding for a number of years, and are quite uniformly interpreted. However, a less than superficial analysis of these rules proves otherwise. Almost all important issues here may be open to question, in some cases vital indeed. A review of the related criminalisation and penalisation issues, based upon the Transplantation Act of 2005, suggests that penal regulations require amendments, chiefly concerning legislative techniques. Any further changes in the related criminalisation and penalisation issues are, most probably, out of the question. Naturally, when the legislator introduces statutory regulations concerning medically-supported procreation, the picture is expected to change dramatically.
