Summary/Abstract: The institution described in the art. 349 of the Code of Criminal Procedure has a vital meaning in the hearing’s preparation, keeping the trial pace principle and the principle of concentration of evidence. Implementing obligatory primary sitting is intended to prepare the criminal proceedings properly, when it is necessary to conduct the hearing of evidence at least five terms. This solution should obviate the prolixity of the criminal law before the courts of first instance and likewise harmonize with the main aim which guided the amendment efforts – extending the principle of adversary trial proceedings.
