The issue of partial decriminalization introduced by the Law of 27 September 2013. amending the Act - Code of Criminal Procedure and some other acts

Summary/Abstract: The article presents the problem of partial decriminalization ie. move to a specific category of crime offenses, introduced by Act of 27 September 2013 Amending the Act - Code of Criminal Procedure and some other acts. The entry into force of this Act on 9 November 2013, required to replace many performed penalties. The provisions laid down in the lap Act, however, were imprecise and consequently led to many discrepancies in the case of orchards. The article presents the most important problems, and has been cited Supreme Court's rulings in this regard.
