Penalties for the possession of drugs in the light of the anti-drug laws

Summary/Abstract: The main theme of the article is the presentation of basic doubts connected with interpretation of the feature “drug possession” in counteraction of the drug habit act. These doubts are still actual, despite the fact that Polish Supreme Court pronounced many sentences about that matter. In opinion of author – in contrast to Supreme Court – this feature should be interpreted in narrow way, according to its meaning in civil law. Different interpretation could guide to contradictions in interpretation of the other terms from counteraction of the drug habit act.
