General theory of the offence

Summary/Abstract: The new Criminal Code has brought essential changes with regards to the general theory of the offence: it was discarded the social danger and returned to the structure of the offence indicated by Professor Traian Pop at the beginning of XX century. For this reason we have considered useful to publish a translation from the German doctrine, the main source of inspiration of “Cluj School”, of which ideas are at the basis of the New Criminal Code, enforced since 1st February 2014.
