Certain Considerations Regarding the Inheritance of Intellectual Property Rights

Summary/Abstract: This article deals with the issue of inheritance of copyright by legal and testamentary successors of the holders of such rights. This work brings side by side the provisions regarding inheritance comprised in the Civil Code, and the provisions of the special laws concerning the transmission by succession of the rights resulting from intellectual creations. The study emphasizes certain legislative inconsistencies and gaps regarding this matter and presents the points of view existing in the doctrine and the points of view of the author with respect to the interpretation of legal provisions in the field under analysis. The author addresses the specialists in the field, urging towards an increased focus of efforts in order to give a certain heuristic character to the analysis of regulations that concern a given topic and are comprised in distinct areas of law.
