Summary/Abstract: Lisbon Treaty on the Functioning of the European Union regulates in Article 50 possibility of the Member States to withdraw voluntarily respecting national constitutional provisions. BREXIT (Britain and exit) is the term that has been named Britain's withdrawal from the European Union. Following a consultative referendum held in the UK in June 2016, 52% of the votes cast were in favor of leaving the EU. The new prime minister of Great Britain, Theresa May announced that by the end of March 2017 the government he leads will invoke Article 50 of the Treaty on the Functioning of the European Union, triggering the formal withdrawal, it will be finalized by in late March 2019 4. Beyond the political and economic implications, unprecedented in the over 60 years of the European Union (including the three European Communities), the procedure of withdrawal from the European Union and Brexit site raises a number of legal issues,uniqueness being the consequence of the that such a procedure has never been used again anyway not in this form, on the one hand and, on the other hand, it is a state belonging to the system of common law based on judicial precedent which, in this case , does not exist.
