My genetic information or our? Disclosure of genetic data on social networks

Summary/Abstract: The article provides the legal analyses of disclosure of one’s genetic profile on social networks. Currently, on the grounds of information contained in human’s DNA, it is possible to determine consanguinity between people, their characteristic features or predispositions for various illness. Although, it has to be noticed that information contained in one’s genetic profile provides also information concerning persons related with this person, as well as information regarding all humans. In result of disclosure of one’s genetic information the other person’s right may be violated, especially the third person’s right to privacy or right to ignorance about its genetic data. A remedy for such violation may provide especially the article 24 of the Polish Civil Code and provisions of the Act on protection of personal data. In author’s opinion protection of third person right may not result in conclusion, that disclosure of one’s genetic profile is unacceptable. The disclosure of one’s genetic information is an exemplification of individual freedom and autonomy of person, which execution may not however result in violation of third person’s subjective rights.
