Summary/Abstract: On October6, 2016 at the initiative of the Association of Prosecutors in Romania and the Romanian Foundation for Democracy through Law, with the support of the Committee for Legal Matters of the Chamber of Deputies took place, at the Palace of Parliament, an interesting debate on the above mentioned theme. Both presidents of the two chambers of the Parliament, important personalities from the judiciary sector and law professors attended the event. As one who had some concerns in this regard and tried through several papers to present how constitutional democracy it is done, in concrete, and how the rule of law practically works in our country, I have found it necessary to draw up some ideas. My largest opinion is that the independence and credibility of the justice must be assessed not only by the rules of organization and functioning of the judiciary system but especially by the quality and accuracy of the solutions given. Moreover, fairness of solutions can only be guaranteed if the person who is judging is impartial. Impartiality is the condition for a fair justice. Only an impartial justice can be independent. The justice seeker is not interested to know who appoints the judges or controls their activity or how the Superior Council of Magistracy is elected. What interests them is how the justice system and the judges impartially apply the law.
