Summary/Abstract: The legislation enactc more and more laws regulating economic ratios. It seems that in certain areas their implementation can be logically justified. However, in the case of the increasing criminalization of drug related activities, which occurred during the transformation, it leads to excessive paternalism and raises interpretation problems. The object of this study will be the regulation of the drug market, the aim of which is to protect public health. This institution restricts freedom, especially personal liberty in the sense of personal rights and economic in the sense of the right to dispose their assets. Consumption of these substances generates negative externalities, whose formation is an argument in favor of state intervention. It is expected that when the activity isexpensive, the state withdraws from the impact. The aim of this article is to answer the question whether the prohibition as a method of regulating the drug market, adopted in the 90’s, seems to be effective and socially desirable.
