Summary/Abstract: The author examines two issues related to the regulation of lease contract in the Civil Code entered into force in 2011. First, the legal texts concerning the direct enforceability of lease contracts for the payment of the rent and for the return of leased property are interpreted. Secondly, it is concluded that the preference right of the tenant for a new lease is a self-standing “potestative” right, distinct from the right of pre-emption.
