The Relationship Between the Church and the State, the Legal Status of the Church in Romania

Summary/Abstract: After 1989, the Romanian government tried to sort out the relationship between the churches.Accordingly, in the new Constitution from 1991 they regulated the status of freedom of religion and the church, which is based on the recognition of the autonomy of the churches.This study presents a rather complex relationship between state and church, as well as the status of recognized churches in Romania. The relationship between church and state is essentially constitutional in nature, as it is linked to fundamental rights such as freedom of conscience, freedom of speech and the phrase, as well as religious freedom. This study presents a wide variety of models that the relationship between church and state created in Europe and the United States, analyzes the content of those basic rights, and the constitutional and legal frame for the legal status of churches.All this may be important, because this relationship is developed in the past twenty-five years, its features, the results and the shortcomings are an important indication of the Romanian rule of law and democratic transformation.
