Summary/Abstract: The author presents in this article the problem of the number of mortgages regulated in the Civil Code of Romania. Therefore, commentaries are acknowledged on the terminology and on the (re)instauration of a guarantees system that is real, on the introduction of the notion of „mortgage” in the real estate field, on the tradition of the mortgage, on its regulation in the Civil Code and also on the as insurance of transition between the old regulation and the new one, while taking into consideration the doctrine elaborated by important names in the field of law (A. Savin, R. Leşe, O. Căpăţînă, É. Lambert, V.-D. Zlătescu, A.-A. Moise). In closing, the author considers that the Civil Code of Romania has managed to offer a unified legal status of the mortgage, regardless of the way it is manifested.
