Summary/Abstract: The European concerns with respect to preventing and fighting cybercrime materialized in the Council of Europe Convention on Cybercrime. As a reflection of such concerns, the Draft on preventing and fighting cybercrime was included in Title III of Romanian Law no. 161/2003. In the same context, most ecommendations which incriminate cybercrimes were also entered in the future Romanian Criminal Code as well. As in other countries, the implementation in the Romanian legislation of the convention provisions generated a number of problems which have been more or less noted and solved. This study attempts to pinpoint such problems.
