CASE STUDY: LOCAL COP „007 AGENT” IN THE THE CASE LAW OF THE DISTRICT COURT AND TRIBUNAL FROM SIBIU IN CONTRAVENTION MATTERS REGARDING CONSTRUCTIONS AND TOWN PLANNING

Summary/Abstract: Sometimes we are witnessing abuses or mistakes of the public administration toward citizens, situations that can be remedied, finallz, with the help of courts. The present case study considers the issue of abuse of power by the police agents of the Local Police Publice Service in contravention matters regarding constructions and town planning. Obviously, the national legislator wanted to prevent someone without specialized training to apply sanctions in an area that exceeds its expertise, as it is the case if we look at the local police agent. However, as we will show in our study, in an entirely unfortunate case-law offered by Civil Sentence no. 2720 of 11th of May 2015 of the District Court from Sibiu and Decision no. 16804 of 12 of November 2015 of the Tribunal from Sibiu gives local police officers competences that exceed their professional training.
