Considerations on the enforcement in case of assignment of claims arising from credit agreements

Summary/Abstract: Article 120 of the Government Emergency Ordinance no. 99/2006 stipulates that credit agreements, including collaterals or personal securities, entered into by a credit institution are writs of execution. This study aims to analyse the controversies arisen in case-law in the event of enforcement of claims arising from credit agreements at the request of companies assigning such claims.
