Summary/Abstract: Undertaking additional employment occurs in many countries regardless of the binding socioeconomic system. However, despite the paramount freedom to work rule there still remain legal constraints to undertaking additional employment in many democratic countries. With regard to Poland, even after removing the requirement to gain consent for additional employment from the labour code, constraints still exist in many labour regulations within the polish legal system. While there are no statutory limitations with regard to “other” employees, which is the result of labour law liberalization, it is controversial whether there still exists a possibility of establishing a conventional limitation, or prohibition, of undertaking additional employment. This paper presents pivotal problems and changes in law regulations concerning additional employment made after the change of the socio- economic system in Poland after 1989.
