Summary/Abstract: In accordance with the Polish Constitution, to the extent specified by the statue, the Deputy (Senator) shall not be permitted to perform any business activity involving any benefit derived from the property of the State Treasury or local self- government, and to acquire such property. For violation of these prohibitions he shall be brought to accountability before the Tribunal of State, but only with the consent of the Sejm (Seym)/Senate. The statute about the holding of a mandate of the Deputy (Senator) of 1996 seriously limits this responsibility. The author critically analyses this regulation and postulates changes in the Polish law, necessary for protection of the authority of the Constitution and Parliament.
