Summary/Abstract: I would like to summarize the above points in the following: It is obvious that criminal law is increasingly used for security policy, risk management and security. Thus, the criminal law is removed from the actually indispensable, namely, guilt and proportionality, as well as the understanding of criminal law as ultimate and its "fragmentary" character. Effective constitutional and human rights control is of crucial importance for the inclusion of a security offense.
