Summary/Abstract: The right to life and health is one of the basic human rights. The Constitution grants the citizens irrespective of any criteria the right to protection of life and health and the right of equal access to health care services publicly funded. These constitutional guarantees translate into specific legal obligations set out in ordinary legislation – not only the prohibition of depriving life or health of another human being, but also warrant of saving the life in situations of its dangers. Polish legislator has introduced the relevant provisions on the unconditional obligation to immediately provide medical services to people in need, but did not specify the sources of their funding when the uninsured people benefit from the assistance. This situation causes the greatest problems of therapeutic entities that are not being able to refuse to provide medical assistance to the patient in case of threat to life or health, they alone bear the burden of financing these benefits. It is necessary to take legislative action in order to clearly identify the entity responsible for financing life-saving activities to people who are not beneficiaries of the health care system.
