Summary/Abstract: The opinion of the Civil Law and Private International Law Department in the Silesian University on the Proposal for a Council Regulation on jurisdiction, applicable law and the recognition and enforcement of decisions in matters of matrimonial property regimes (on December 20-th, 2012) is presented in the paper. The text focuses on conflict of law issues. The most important changes are proposed in art. 19, 20, 20b, 22. The most difficult issue to be solved is connected with the effect of matrimonial property regime in respect of third parties. This problem cannot be solved without the introduction of the European common register of matrimonial property regimes. The proposal of the formal requirements of a matrimonial property agreement is also criticized. The form of the agreement should be regulated separately in the Regulation without referral to the national legal systems. It should also ensure the objective information of the date of the agreement (for example official certification of the date).
