Sejm draft position on case ref. no. K 49/15 concerning the Act of 20th June 1997 – Law on the Road Traffic (WPTK-739/16)

Summary/Abstract: This draft position of the Sejm concerns themotion filed by the Council of the Municipality of Kobylnica on 6th October 2015. In theproposed draft position the author claims that the contested Article 129b para. 2 subpara.1 of the Law on Road Traffic, insofar as it does not confer the power to control theroad traffic using the recording devices to municipal (or city) guard, is in compliancewith the Constitution. In the remaining scope of the motion the proceedings shouldbe discontinued pursuant to the Article 40 para. 1 subpara. 1 of the Act of 22th July2016 on the Constitutional Tribunal due to the inadmissibility of the judgment.
