Summary/Abstract: Business activities led by local governments, in particular outside the sphere of public utility, involve the risk of irregularities. Since these activities are carried out usually by municipal companies which obtain communal property for this purpose, it should be monitored whether such property is used by these companies in an appropriate manner and in accordance with its objectives and whether it serves to perform public tasks. Therefore, a very important role in this respect is played by owner supervision over communal companies. The article is an attempt to answer the questions of how municipalities exercise the supervision over communal companies and whether it is active surveillance or rather passive but finally effective. In addition, the Authors present the problem of the possible control of communal companies by municipal councils.
