Summary/Abstract: The performance of business activities on own behalf determines the qualifications ofthe entity for the category of entrepreneurs only if it relates to activities that should be -because of their objective and functional features – classified as economic activities. Theseactivities are a constructive part of an entrepreneur. In case of individuals, the lack of legalcapacity seems to make the active conduct of business activities impossible. At the sametime it means the failure to meet the statutory requirement to participate in legal transactionson their own behalf of persons wishing to obtain legal status of an entrepreneur.The feature of “performing the economic activity on his/her own behalf ” is not useful tocharacterize the activities of legal persons and organizational units which do not havelegal personality but do business, not so much in their own name, but within the limits ofits legal capacity, on their on responsibility, at their own risk and under their own name.Acting on their own behalf is only a consequence of the fact that legal entities are equippedwith the ability to undertake activities which have legal effects in the form of rights andobligations acquired by entities as a result of these actions
