Collecting Information and Determining the Factual and Legal Circumstances Necessary for the Conduct of Judicial Enforcement

Summary/Abstract: The article aims to present a complex analysis of collecting information and determining the factual and legal circumstances necessary for the conduct of judicial enforcement. The knowledge about debtor’s assets is a means of quick and effective satisfying of creditor’s rights in the enforcement proceedings. The bailiff ’s knowledge can come from any source, as long as it is obtained in a manner consistent with law. The Author discusses the ways of obtaining information, hearing of parties, disclosing assets, demanding explanations and gathering information pursuant to art. 761 § 1 of the Code on Civil Procedure, including the search for assets by means of information technologies, requesting information pursuant to art. 2 par. 5 of the Act on Bailiffs and Enforcement, obtaining informationon registration liens, collecting information on court claims and alimony matters, ordering the bailiff search for debtor’s assets and the scope of regulations concerning factual and legal circumstances in the enforcement proceedings, including the determination of factual and legal circumstances on the basis of documents or expert opinions.
