Social Market Economy as a Differentiated System of Information Flow

Summary/Abstract: The purpose of the article is to present organizational and legal elements that are particularly important first to create and then to strengthen the Social Market Economy. One of the key elements of this concept is the Society. The Author is going to define which regulations influence the fact that people who are diversified in many respects turn into the society, and then they form the Community already aware of market knowledge. Due to the legal nature of the research, the narration primarily goes through these legal provisions that can positively revive the Social Market Economy. The Author presents a thesis that according to art. 20 of the Constitution, the Society is established only when it has similar knowledge resources, at least about the foundations of the economic system provided by this act. Therefore, the Author refers to important information obligations provided by legal acts which allow to create such conscious society. In conclusions, a list of legal acts which are vitiated is presented (especially including those acts which create the illusionof the Social Market Economy) with the indication of also positive examples of recent national and foreign legislation.
