Summary/Abstract: The study issues related to the „staatstheoretische” foundation of the legal theory, and the construction of the political concept of the state in the context of Barna Horváth criticism upon John Austin’ theory on jurisprudence. The aim of the study is designed to demonstrate that Horváth’ criticism in fact trends for the intellectual annulment of Austin’s theory of the sovereignty as unscholarly ideology. In his argument Horváth leaves the terrain of the science, in responding to the logic of the „political” unconsciously.
