Summary/Abstract: Environmental damages as a factor that threat environmental security represent ecosystem damages due to human activities or risk of depletion of constitutions or recourses which are valuable for human existence. As for transboundary environmental damages which are defined as environmental damages, which occurs as a result of dangerous activities by a country or taking place in a territory of a country, affecting other country territories and national jurisdictions or international territories negatively by going beyond the country's borders; may cause nuclear pollution, marine oil transportation, air, water and soil pollution and harmful effects of hazardous substances. The most dangerous source that causes transboundary damages is nuclear pollution. Activities that may cause nuclear damages are the nuclear tests especially on the high seas, nuclear power plants, nuclear ships and radioactive wastes discarded by leakage and accidents during the transportation of nuclear materials. These activities may result in devastating consequences out of human’s control and with no return. This study which aims for elimination of transboundary nuclear damages expressed an international regime and a set of proposals for the settlement of environmental conflicts on the case studies of Chernobyl and Fukushima transboundary nuclear damages in the future under the name of environmental liability.
