Summary/Abstract: Patient’s safety constitutes a keystone and a common denominator of the modern health systems. Unwelcome events happen in every health system and include, for example, patient’s falls,surgical procedure performed on the wrong side of the body, administration of an impropermedication or suicide of a hospitalised patient. In a number of instances they result not so much from a human factor but are rather due to a system or organisational issue. Of great importance in augmenting the patient’s safety throughout various health systems is the assurance of patient’s rights’ real protection, as the fundamental element of the State’s health policy, and an indispensable ingredient of every day functioning of medical entities. The article discussesthe right to effective health protection from the viewpoint of the Constitution of the Republic of Poland, and that of the Council of Europe and of the Council of the European Union recommendations.
