Summary/Abstract: The subject of the paper is consumer welfare at the abuse of dominant position in the law of Bosnia and Herzegovina. The rights of consumers are protected from abuse of dominant position, and there is abuse when limiting production, market or technical development to the prejudice of consumers.Consumer protection is regulated by the provisions of the Consumer Protection Act, which standardized the realization of consumer protection in the relationship between consumers, producers and retailers. The concept of the consumer in this law does not correspond to the concept of the consumer which provides protection in the context of abuse of dominant position.When the abuse of dominant position in the law of Bosnia and Herzegovina provides protection for a wider circle of persons, but that does not correspond to practice in this type of competition in the European Union. Consumer welfare is to protect the wider circle of persons, with the consumers welfare primarily analyzes from an economics tandpoint. In our practice we do not find the protection of consumers through consumer welfare, for which it can be say that the new legal standard in the European Union, already in Bosnia and Herzegovina term consumer includes a small number of persons.
