Evidence in the Proceedings for Declaration the Invalidity of the Marriage and in Divorce Proceedings

Summary/Abstract: The main purpose of the following study is attempt to compare of two proceedings i.e. the proceedings for declaration the invalidity of the marriage (in canon law) and divorce proceedings (in Polish law), in particular to point out similarities and differences of evidence which refer by the parties in both proceedings. Undoubtedly on the basis of the canon law evidence serve different purpose than on the basis of the Polish law. While established evidence in the proceedings for declaration the invalidity of the marriage could be almost always establish in divorce proceedings, there is not necessarily be in the opposite situation. The following study is aimed at closer inspection of both legal systems.
